BEAR — Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of [website URL] (the “Site”) and your purchase of single issues or subscriptions (together, the “Services”) from Beard & Bear LLC (“BEAR,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms.

1. Eligibility & Age Requirement

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to access the Site or purchase our Services. By placing an order, you certify that you are of legal age to view and purchase adult-oriented content in your jurisdiction and that doing so does not violate any local law applicable to you.

2. Content Disclaimer

The Site itself displays mature and suggestive imagery only and does not display sexually explicit content. Our printed magazine, shipped to purchasers, contains explicit adult content intended for a mature audience. By purchasing, you acknowledge and accept the nature of the printed product and certify you are legally permitted to receive this type of material in your location. If you are not, do not place an order.

3. Orders, Pricing & Payment

  • All prices are listed in [USD] and are exclusive of applicable tax and shipping, which are calculated and added at checkout.
  • We reserve the right to change prices for future orders at any time; changes won’t affect orders already placed.
  • We reserve the right to refuse or cancel any order, including for suspected fraud, pricing errors, or inability to verify age, in which case we will refund any amount charged.
  • Payment is processed by our third-party payment processor, CCBill, LLC, at the time of order. CCBill may perform its own age or identity verification checks as part of processing high-risk transactions; declined or flagged orders may not be fulfilled.

4. Subscriptions

Our annual subscription is a one-time, non-renewing purchase of four (4) issues. It does not automatically renew or rebill at the end of the term. If you want to continue receiving BEAR after your four issues, you’ll need to place a new order.

5. Shipping & Delivery

  • We ship to most countries worldwide, except as set out in “Shipping Restrictions” below.
  • All orders are shipped in plain, discreet packaging with no exterior indication of contents.
  • You are responsible for ensuring that receiving this publication is lawful in your country and for any customs duties, import taxes, or fees imposed by your country. BEAR is not responsible for shipments delayed, seized, or destroyed by customs or postal authorities, and is not able to issue refunds for shipments blocked by customs or import restrictions outside our control.
  • Estimated delivery times are approximate and not guaranteed, particularly for international orders.
  • Risk of loss and title to items pass to you upon our delivery to the shipping carrier.

Shipping Restrictions

Due to legal restrictions in certain countries on the import of explicit content and/or the distribution of LGBTQ-themed publications, we do not currently ship to the following countries:

Countries restricting import of sexually explicit material: Afghanistan, Algeria, Bahrain, Bangladesh, Brunei, China, Cuba, Egypt, Eritrea, Ethiopia, Indonesia, Iran, Iraq, Jordan, Kuwait, Libya, Malaysia, Maldives, Mauritania, Morocco, Myanmar, Nepal, North Korea, Oman, Pakistan, Qatar, Saudi Arabia, Somalia, Sudan, Syria, Tunisia, Turkmenistan, United Arab Emirates, Uzbekistan, Vietnam, Yemen

Countries with laws restricting distribution of LGBTQ-themed content: Georgia, Hungary, Kazakhstan, Russia

We review and update this list periodically as laws change; it is not exhaustive, and we reserve the right to decline or cancel any order — including refunding the order in full — to a destination we determine, in our discretion, poses a legal risk not covered above.

6. Refunds & Cancellations

Single issues and subscriptions are non-refundable except as described in our Refund Policy, which covers non-delivery, damaged items, and billing errors.

7. Intellectual Property

All content in the magazine and on the Site — including text, images, photographs, layout, and design — is owned by BEAR or its licensors and protected by copyright and other intellectual property laws. You may not reproduce, distribute, publicly display, or create derivative works from our content without our prior written permission, except for personal, non-commercial use.

8. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Attempt to access the Site if you are under 18
  • Scrape, harvest, or use automated means to extract data from the Site without permission
  • Impersonate any person or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the Site’s operation or security

9. Disclaimers

The Site and Services are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, BEAR and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Site or Services. Our total liability for any claim arising from your order will not exceed the amount you paid for that order.

11. Indemnification

You agree to indemnify and hold BEAR harmless from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Site or Services.

12. Governing Law & Dispute Resolution

Governing Law. These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Agreement to Arbitrate. You and BEAR agree that, except as set out below, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services will be resolved by binding, individual arbitration rather than in court.

Class Action Waiver. You and BEAR agree that any arbitration will be conducted on an individual basis only, and not as a class, collective, or representative action. The arbitrator has no authority to consolidate more than one person’s claims or to preside over any class or representative proceeding.

Arbitration Procedure. Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The arbitration may be conducted by telephone, based on written submissions, or in person in [County, State], at the arbitrator’s discretion. For claims under $[10,000], BEAR will pay all AAA filing, administration, and arbitrator fees, except where the arbitrator determines the claim is frivolous.

Exceptions to Arbitration. (a) Either party may bring an individual claim in small claims court instead of arbitration, if the claim qualifies for that court. (b) BEAR may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information, without first pursuing arbitration.

Right to Opt Out. You may opt out of this arbitration agreement by sending written notice to hello@thebearmag.com within 30 days of first accepting these Terms. Your notice must include your name, order/account email, and a clear statement that you wish to opt out of arbitration. If you opt out, this arbitration provision won’t apply to you, but the rest of these Terms will still govern.

International Consumers. If you are a consumer located in the European Union, United Kingdom, or another jurisdiction where local law grants you a non-waivable right to bring claims in your home courts or through a specific consumer-protection process, this Section 12 does not limit that right, and applicable local law controls to that extent.

13. International Users

The Site is operated from the United States. We make no representation that the Site or its content is appropriate or legally available for use in every location. If you access the Site from outside the U.S., you do so at your own risk and are responsible for compliance with local laws, including laws regarding adult content.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms. Material changes will be posted here with an updated “Last updated” date.

15. Termination

We may suspend or terminate your access to the Site at any time, for any reason, including violation of these Terms.
